Shipping policy

ERNEST LEOTY retains ownership of the Products ordered until full payment of the corresponding price has been received.

4.1 Delivery Location and Delivery Fees

The Products are available for delivery to the following countries and territories: France, European Union, United Kingdom, Liechtenstein, Norway, Sweden, Switzerland, United States.

The Products will be delivered to the postal address provided by the Customer when placing the order and specified on the delivery receipt. The Customer must carefully complete all fields of the delivery form when placing the order, including their delivery address and a valid phone number (landline or mobile). Neither ERNEST LEOTY nor the delivery company can be held liable for failed delivery due to inaccuracies or errors in the delivery address.

The total cost, including taxes (VAT), of the Customer's contribution to logistics preparation (processing and shipping) and delivery fees will be indicated to the Customer before the final confirmation of the order.

Delivery is carried out by courier, chosen by the Customer from the delivery options available, which are determined based on the package's weight and dimensions.

Packages are delivered by courier. The Customer must provide a delivery address where a person can physically receive the package on the first delivery attempt (e.g., workplace, the home of a friend or family member, concierge, etc.).

Since delivery is managed by a third-party provider, the Customer acknowledges and accepts that ERNEST LEOTY cannot be held responsible for any failure or improper performance of the delivery obligation if it is attributable to the Customer, a third party to the contract, or a force majeure event.

In the event of a failed delivery on the agreed date due to incorrect information, unreported access issues, or the Customer's absence contrary to prior arrangements, additional delivery fees may be charged. ERNEST LEOTY will contact the Customer to collect payment for these new fees before attempting a new delivery of the Product. If these fees are not paid, ERNEST LEOTY reserves the right not to proceed with the Product's delivery. Any risks of damage resulting from these constraints will also be borne by the Customer.

4.2 Delivery Times for Products

An estimated delivery time for each Product will be displayed on the website in the corresponding product description.

The final delivery time will be indicated to the Customer during the order process, before the order confirmation and payment. If an order includes Products with different delivery dates, delivery will be made in a single shipment based on the latest delivery date.

4.3 Delayed Delivery

Any delay in delivery must be reported in writing by the Customer to ERNEST LEOTY as soon as possible, so an investigation can be conducted with the relevant couriers. The Customer may cancel their order if the delivery has not occurred by the originally indicated date, provided the delay is not due to the Customer or a force majeure event.

Upon exercising the right to cancel or following the conclusions of ERNEST LEOTY's investigation confirming the loss of the package, ERNEST LEOTY will refund the amount debited to the bank account used for the order within a maximum of fourteen (14) days from the receipt of the cancellation request. Alternatively, the Products may be resent at no additional cost if the order has not been canceled by the Customer.

For partial deliveries of an order, delivery may be completed in multiple shipments, and the cancellation right will only apply to the undelivered portion of the order.

4.4 Receipt of Products by the Customer

Each delivery is considered completed upon the Products' handover to the Customer by the courier, as evidenced by the tracking system used by the courier. Any disputes regarding the delivery itself will not be accepted if the package is marked as delivered, as indicated by the courier's system.

Without prejudice to the withdrawal rights detailed in Article 5 below, upon delivery, the Customer must unpack the Product in the presence of the Courier and verify that it matches the order and is free from damage before signing the delivery receipt.

In the event of anomalies, the Customer must record detailed, dated, and signed handwritten reservations on the Delivery Receipt. These reservations serve as proof of the existence and extent of the damage. Similarly, if a delivery error is identified, the Customer must specify the nature of the error (e.g., incorrect color, wrong product).

In case of error or damage, the Customer must refuse the Product and submit their reservations within five (5) days by email via the “Contact” section of the website and simultaneously by registered letter with acknowledgment of receipt to the following address: ERNEST LEOTY, Customer Service, 200 Boulevard Saint Germain, 75007 Paris.

Claims made beyond this period cannot be accepted. If no reservations are made, the delivered Product is considered satisfactory and cannot be contested later. For example, the Customer cannot make claims against ERNEST LEOTY or the Courier after the Courier's departure, even if the package was not opened in the Courier's presence.

Except in cases of non-conformity or hidden defects, no subsequent claims or reservations will be accepted by ERNEST LEOTY after the Products have been received by the Customer, if the procedure described above was not followed.
